Faith Computing Pty Ltd (ABN 94 138 361 510) trading as Profit Platform
This Acceptable Use Policy (AUP) applies to your use of the Profit Platform software platform at my.profitplatform.com.au and related domains, provided by Faith Computing Pty Ltd (ABN 94 138 361 510) trading as Profit Platform.
It forms part of, and is read together with, our Terms of Use. By using the Platform you agree to comply with this AUP and to ensure your staff and any sub-accounts you grant access to also comply.
You must not use the Platform to engage in, facilitate, or store any activity or content that is unlawful, fraudulent, deceptive, defamatory, harassing, threatening, or that infringes the rights of any third party, including intellectual property and privacy rights.
Without limiting clause 1, you must not use the Platform to:
(a) promote or facilitate illegal goods or services, including unauthorised pharmaceuticals, weapons, or controlled substances;
(b) operate pyramid or multi level schemes with no genuine product, unlicensed gambling, or fraudulent or unlicensed financial offers;
(c) distribute malware or phishing content, or attempt unauthorised access to any system;
(d) collect, store or process sensitive information, including health, biometric, criminal record or financial account information, without a lawful basis, appropriate security and the necessary consents;
(e) impersonate any person or entity, or misrepresent your affiliation with any person or entity, including us;
(f) publish or distribute content that sexualises or exploits children, or that promotes violence or hatred against any group; or
(g) generate or distribute synthetic audio, video or images that impersonate a real person without their consent.
3.1 You must not use the Platform’s email, SMS, RCS, voice calling or AI voice features to send unsolicited communications in breach of applicable anti spam or telemarketing law. Your obligations are set out in the SMS, Email and Voice Compliance Addendum.
3.2 You must not send content that is misleading or deceptive, disguise the origin of a message, spoof caller ID or sender information, or use the Platform to circumvent a carrier’s filtering or registration requirements.
3.3 You must not record any call without the consent required by law. See clause 5 of the Compliance Addendum.
You must not:
(a) probe, scan or test the vulnerability of the Platform or any connected system without our prior written permission;
(b) interfere with or disrupt the Platform, its servers or networks, including by overloading them;
(c) introduce any virus, worm or other malicious code;
(d) access the Platform by automated means outside our published APIs, or exceed documented API rate limits; or
(e) circumvent any access control, usage limit or security measure.
5.1 Features described as unlimited are provided on a fair use basis, meaning use consistent with ordinary use by a business of similar size and type.
5.2 If your usage is significantly disproportionate to ordinary use and affects Platform performance for others, or materially increases our third party costs, we will contact you and give you a reasonable opportunity to moderate your usage.
5.3 If usage does not moderate after we have raised it, we may apply rate limits, or ask you to move to a plan or add on that reflects your usage. We will not suspend your account for fair use reasons without first raising it with you, unless the usage is causing an immediate operational or security problem.
6.1 If you provide sub-accounts or Platform access to your own clients, you remain responsible for their compliance with this AUP and for handling any dispute or complaint about their use of the Platform.
6.2 You must ensure your clients are bound by terms at least as protective of us as this AUP.
6.3 We may require you to suspend a sub-account we reasonably believe is breaching this AUP. If you do not do so within a reasonable time, we may suspend it ourselves.
If you become aware of a breach of this AUP, whether by your own users or anyone else, please tell us at admin@profitplatform.com.au.
8.1 A breach of this AUP is a breach of our Terms of Use.
8.2 Depending on the seriousness of the breach we may issue a warning, require you to fix the problem within a stated time, restrict or disable a specific feature, or suspend or terminate your account.
8.3 We will give you notice and a reasonable opportunity to fix the breach before suspending or terminating, unless immediate action is necessary to protect the Platform, our other customers, a third party, or to comply with a legal or carrier requirement. Where we act without prior notice, we will tell you the reason as soon as reasonably practicable.
8.4 The suspension and termination process in clauses 14 and 15 of the Terms of Use applies.
We may update this AUP to reflect new features, new risks or changes in law. Where a change materially increases your obligations, clause 21 of the Terms of Use applies, including your right to cancel without penalty before the change takes effect.
